Magicities reserves the right to suspend or cancel a customer's access to any or all services provided by Magicities when Magicities decides that the account has been inappropriately used. Illegal Use of Services
Transmission, distribution, or storage of any information, data or material in violation of United States or state regulation or law, or by the common law, is prohibited. This includes, but is not limited to, material protected by copyright, trademark, trade secret, or any other statute. Magicities reserves the right to remove such illegal material from its server immediately. Magicities expressly forbids anyone from using Magicities's servers for the propagation, distribution, housing, processing, storing, or otherwise handling in any way lewd, obscene, or pornographic material, satanic material, or any other material which we deem to be objectionable. The designation of any materials as such described above is left entirely to the discretion of the Magicities management.

Unlawful or Unethical Use
Magicities does NOT allow sites that provide points of distribution, or links to the following types of sites:
Adult Sites - Any erotic or pornographic material, links to adults sites, or advertisements for adult sites.
Pirated Software (Warez) - Any software that is copyrighted and not freely available for distribution without cost. Including: ROMs, ROM Emulators, Mpeg Layer 3 files (MP3) and DVD Videos.
Hacking / Phreaking - Includes sites with material, links, or resources for Hacking, Phreaking, Viruses, or any type of site that compromises the integrity of Magicities.

E-Mail Policy
Magicities strictly prohibits harassment, whether through language, frequency, or size of messages. Forging of header information is not permitted. Magicities does not allow unsolicited mail (UCE). This includes "Spamming" and "Bulk Mail" sent to persons who have otherwise not requested to receive such mail. The reason for this is that not only is it generally frowned upon by the internet community, but it also demands extra bandwidth to handle the effects of such mail. Websites participating in these activities wlll be immediately terminated without notice.

Magicities Services are Not to be Resold or Given away
Customers cannot sublease, subhost, or give away control of any portion of Magicities's resources. For customers who do wish to sublease web space, Magicities parent company, Magic-Host offers that ability.

High bandwidth sites and/or abuse of resources
Magicities discount hosting does not host very high bandwidth sites and will not tolerate any abuse of server resources whatsoever. This includes spam and cgi abuse as well as any high resource demanding activity. Magicities reserves the right to cancel any such sites without notice. If you are unsure whether your site is a "high bandwidth" site, contact us at support@magicities.com.

"What is considered cgi abuse?" Any site whose CGI programs are using excessive amounts of system resources would be considered an offending site. Excessive amounts means any amount that results in substantial degradation of server performance.Magicities is the sole determinant of what constitutes degraded server performance.

Payment Policies
All accounts are setup automatically and billed in real time, Confirmation emails should arrive within 10 minutes to the email specified in your online signup form. If a problem arises with the account, the user will be notified via e-mail. All new accounts will be billed on the aniversiry date of the account being setup. All accounts are set up on a prepaid basis. Setup fees are charged for all new accounts and are non-refundable. Magicities reserves the right to change prices at any time. No bills or invoices will be sent by regular mail. The customer is responsible for all money owed on the account from the time it was established to the time that the customer notifies Magicities for a request for termination of services. All payment must be in US funds.

Cancellation
Magicities reserves the right to cancel service at any time. Customers can also cancel service any time. Accounts can be canceled by the account holder at any time by either using our online cancellation form. If the account is cancelled within 30 days from the date of subscription, a refund of your 12 month total minus the setup fee will be issued to the credit card used at signup. The online account will then be shut down at the end of the current billing period, unless a date of cancellation is specified. No refunds will be granted after 30 days. Partial or prorated refunds are not disbursed.

Disclaimer
Magicities will not be responsible for any damages your business may suffer. Magicities makes no warranties of any kind, expressed or implied for services we provide. Magicities disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Magicities and its employees. If user decides to bring any legal proceedings against Magicities, user will occur all legal fees and court cost's.

Finally, Magicities wishes to emphasize that in accepting services, subscribers indemnify Magicities for any violation of the subscriber of the Services Agreement, or of law or Magicities policy, that results in loss to Magicities or the bringing of any claim against Magicities. This means that if Magicities is sued because of activities of the subscriber that violate any law, the Services Agreement or this policy (which is part of the Services Agreement), the subscriber will pay any damages awarded against Magicities, plus costs and reasonable attorneys' fees.

Magicities reserves the right to revise its policies at any time without prior notification.
